Unlike other names that are used to refer to a specific species of animals, Tucson gopher is mostly used when referring to small rodents that burrow themselves in the ground. May 2, 2002 adopted the Animal Control Code (Title 1C, Chapter 1) & repealing existing Animal Control Ordinance, Resolution C05-09-02.

Adopted January 28, 2003 as Pascua Yaqui Code and rescinded all prior code by Resolution No. C01-04-03.

Amended on April 6, 2016 by Resolution No. C04-47-16 and Ordinance No. 11-16.

This chapter shall apply to all matters involving control of animals on lands within the jurisdiction of the Pascua Yaqui Tribe.

The position of Animal Control Officer is hereby established. The Animal Control Officer shall be an employee of the Tribe, and shall enforce the provisions of this chapter under the supervision of the Chief of Police.

By August 1, 2002 the Chief of Police shall present to the Tribal Council a written plan for the establishment of a permanent Tribal Pound facility. The plan shall include: a feasibility study addressing the start-up costs, operating costs, equipment, logistics, location, public safety and health issues, and potential liabilities of an on-Reservation Tribal Pound. The Chief of Police shall develop the Plan in consultation with the Directors of the Procurement Department and the Health Department. Such facility shall be operated by the Tribe, and located within the bounds of the Reservation, and shall be the primary impoundment and housing facility for impounded animals.

The Animal Control Officer shall enforce the provisions of this chapter and any other regulations pertaining thereto, and shall be empowered to issue summons, citations, and complaints relating to this chapter.

Any Tribal Officer of the Peace may enforce the provisions of this chapter.

“Abandon” means to willfully cause or allow an animal to remain at large with no intent to reclaim or provide necessary food, water, shelter, or medical care.

“Animal” means any fowl, retile, amphibian or mammal, except for human beings.

“Animal Control Center” means any establishment for the confinement, maintenance, safekeeping and control of dogs and other animals that become the custody of the Animal Control Officer in the performance of his official duties.

“Animal Control Officer” means the enforcement officer employed by the Law Enforcement Services Department who is empowered by and is responsible for enforcing this chapter

“At large” means being neither confined by an enclosure not restrained by a leash whole off of owner’s property

“Animal Breeder” means any owner, who provides the means for, or assists, the procreation of animals for commercial or other pecuniary gain.

“Bite” means any penetration of the skin by the teeth of any animal.

“Collar” means a band, chain, harness, or other suitable device worn around the neck of an animal to which a license can be attached.

“Cruel Mistreatment” means to torture or otherwise inflict unnecessary serious physical injury on an animal or to kill an animal in a manner that causes protracted suffering to the animal.

Has been declared to be vicious or destructive pursuant to 8 PYTC§ 6-1-70), or dangerous or vicious or destructive or a danger to the safety of any person or other animal; or

Displays a tendency, disposition or propensity, as determined by established guidelines developed for that purpose, to

Injure, bite, attack, chase or charge without provocation, or attempt to injure, bite, attack, chase or charge without provocation a person or domestic animal in a manner that poses a threat to public safety.

A dangerous animal does not include an animal used in law enforcement and performing official duties or animals in the custody of zoos, wild animal parks or animal shelters or animals under the care of veterinarians.

“Destructive Animal” means any animal that has exhibited a propensity to destroy, damage or cause damage to the property of a person other than the animal’s owner.

Starling - the Starling is another animal that finds the urban setting absolutely ideal for it. These are very social birds, which mean that they will travel in thousands as a colony. They will also gather together in extremely large numbers to sit and perch. Because so many are traveling together, it is necessary for them to have a large supply of food to be able to feed the entire colony. What better place to find such a feast for the group then within the large areas where people live. These birds will feed off of just about anything that they can find. As true scavengers they will enjoy much of the things that people leave as waste. However, like the sparrow, these animals most prefer grains and materials like this. This can easily be found in the breads and other grains that people drop along the city streets every day. It's an ideal feast for this bird.

The interesting thing about these birds is the fact that they would probably not be able to survive in the large colonies the way that they do had it not been for man's intervention in building these large cities. This is true for the sparrows as well. Because man has developed these huge buildings where these birds can roost and get large amounts of food, they are able to thrive and do extremely well primarily because man has created an environment that allows them to do so. This environment also greatly reduces the ability for predators to get at these birds, which makes it absolutely ideal for them to become one of the most dominant species in the urban setting.
